Diese Nutzungsbedingungen regeln deine Nutzung der iOS-App „Prompt En Place" (im Folgenden „App" genannt), die von Nicolas Neubauer (im Folgenden „wir", „uns" oder „Entwickler") bereitgestellt wird.

Verhältnis zur Apple Standard-EULA

Mit dem Herunterladen und der Nutzung der App stimmst du der Standard-Endbenutzer-Lizenzvereinbarung von Apple (Apple Standard EULA) zu. Die vorliegenden Nutzungsbedingungen ergänzen die Apple Standard EULA um spezifische Regelungen für die Funktionen unserer App. Bei Widersprüchen zwischen diesen Nutzungsbedingungen und der Apple Standard EULA haben in Bezug auf die Nutzung der App-spezifischen Dienste diese Nutzungsbedingungen Vorrang.

1. Abonnements und In-App-Käufe

Unsere App bietet Premium-Funktionen, die über ein sich automatisch verlängerndes Abonnement (In-App-Kauf) freigeschaltet werden können.

Abrechnung: Die Zahlung wird bei Kaufbestätigung deinem Apple-ID-Konto belastet.

Automatische Verlängerung: Das Abonnement verlängert sich automatisch, sofern es nicht mindestens 24 Stunden vor Ablauf des aktuellen Abrechnungszeitraums gekündigt wird. Dein Konto wird innerhalb von 24 Stunden vor Ablauf des aktuellen Zeitraums für die Verlängerung belastet.

Verwaltung und Kündigung: Du kannst deine Abonnements verwalten und die automatische Verlängerung jederzeit nach dem Kauf in den Kontoeinstellungen deines App Store-Profils deaktivieren. Wir selbst können dein Abonnement nicht kündigen oder Rückerstattungen vornehmen; dies erfolgt ausschließlich über Apple.

2. KI-Funktionen und Haftungsausschluss (Gesundheit & Sicherheit)

Unsere App nutzt Künstliche Intelligenz (Large Language Models), um Chat-Funktionen und Ratschläge rund um Rezepte und Kochen bereitzustellen. Bitte beachte zwingend Folgendes:

Keine Fehlerfreiheit: KI-Systeme können „halluzinieren" und fehlerhafte, unvollständige oder unsinnige Ergebnisse liefern.

Prüfpflicht des Nutzers: Du bist verpflichtet, alle KI-generierten Rezepte, Zutatenmengen, Kochzeiten und Zubereitungshinweise auf Plausibilität zu prüfen, bevor du diese anwendest.

Gesundheit und Allergien sowie sonstige Schäden: Die KI ersetzt keine fachliche Ernährungsberatung. Wir übernehmen keine Haftung für gesundheitliche Schäden, allergische Reaktionen, Lebensmittelvergiftungen oder Sachschäden (z. B. beschädigte Küchengeräte durch falsche Kochzeiten), die aus der Befolgung der KI-Ratschläge resultieren. Die Nutzung der Vorschläge erfolgt auf eigene Gefahr.

3. Externe Inhalte und Browser-Funktionalität

Unsere App ermöglicht es dir, Internetadressen (URLs) einzugeben, um Rezepte von Drittanbietern direkt in der App aufzurufen und zu laden.

Die App fungiert hierbei lediglich als Browser bzw. technisches Werkzeug zur Darstellung dieser externen Inhalte.

Wir sind nicht die Urheber der aufgerufenen Rezepte, machen uns diese Inhalte nicht zu eigen und haben keine Kontrolle über die Richtigkeit, Rechtmäßigkeit oder Qualität dieser externen Websites.

Wir übernehmen keine Haftung für Urheberrechtsverletzungen, die durch das Aufrufen oder Speichern von externen Inhalten durch den Nutzer entstehen.

4. Allgemeine Haftungsbeschränkung

Wir haften ausschließlich im Rahmen der zwingenden gesetzlichen Vorschriften. Das bedeutet: Eine Haftung unsererseits besteht nur für Schäden, die auf einer vorsätzlichen oder grob fahrlässigen Pflichtverletzung beruhen, nach den zwingenden Vorgaben des Produkthaftungsgesetzes sowie bei Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit.

Jede darüber hinausgehende Haftung (insbesondere für leichte Fahrlässigkeit, für fehlerhafte KI-Ausgaben oder für indirekte Schäden) ist vollständig ausgeschlossen. Wir garantieren nicht, dass die App oder die angebundenen Backend-Services (inkl. KI-API) jederzeit ununterbrochen und fehlerfrei zur Verfügung stehen. Im Übrigen gilt die in der Apple Standard EULA festgelegte Haftungsbeschränkung, soweit sie diesen Nutzungsbedingungen nicht widerspricht.

5. Apple-spezifische Bestimmungen

Kein Apple-Support: Du erkennst an, dass Apple keine Verpflichtung hat, Wartungs- und Supportdienste für die App bereitzustellen.

Drittbegünstigter: Du und wir erkennen an und stimmen zu, dass Apple und die Tochtergesellschaften von Apple Drittbegünstigte dieser Vereinbarung sind und dass Apple das Recht hat (und dieses Recht als angenommen gilt), diese Nutzungsbedingungen gegen dich als Drittbegünstigten durchzusetzen.

6. Anwendbares Recht und Gerichtsstand

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG). Da du die App als Verbraucher nutzt, gilt dies jedoch nur insoweit, als dir dadurch nicht der Schutz entzogen wird, der dir durch zwingende Verbraucherschutzvorschriften des Landes gewährt wird, in dem du deinen gewöhnlichen Aufenthalt hast.

These Terms of Service and all related documents, including the Privacy Policy, are provided in German and English. The English translation is for convenience only. In case of any discrepancies or disputes, the German version shall be the sole legally binding document.

These Terms of Service govern your use of the iOS app "Prompt En Place" (hereinafter referred to as the "App"), provided by Nicolas Neubauer (hereinafter referred to as "we", "us", or "Developer").

Relationship to the Apple Standard EULA

By downloading and using the App, you agree to Apple's standard End User License Agreement (Apple Standard EULA). These Terms of Service supplement the Apple Standard EULA with specific provisions regarding the functionalities of our App. In the event of any conflict between these Terms of Service and the Apple Standard EULA, these Terms of Service shall prevail with respect to the use of App-specific services.

1. Subscriptions and In-App Purchases

Our App offers premium features that can be unlocked via an auto-renewing subscription (In-App Purchase).

Billing: Payment will be charged to your Apple ID account upon confirmation of purchase.

Auto-Renewal: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Management and Cancellation: You can manage your subscriptions and turn off auto-renewal at any time after purchase by going to your App Store account settings. We cannot cancel your subscription or issue refunds ourselves; this process is handled exclusively through Apple.

2. AI Features and Disclaimer of Liability (Health & Safety)

Our App utilizes Artificial Intelligence (Large Language Models) to provide chat functionalities and advice regarding recipes and cooking. Please strictly observe the following:

No Guarantee of Accuracy: AI systems can "hallucinate" and generate incorrect, incomplete, or nonsensical results.

User's Duty to Verify: You are obligated to review all AI-generated recipes, ingredient quantities, cooking times, and preparation instructions for plausibility before applying them.

Health, Allergies, and Other Damages: The AI does not replace professional nutritional advice. We assume no liability for health issues, allergic reactions, food poisoning, or property damage (e.g., damaged kitchen appliances due to incorrect cooking times) resulting from following the AI's advice. The use of any suggestions provided is strictly at your own risk.

3. External Content and Browser Functionality

Our App allows you to enter website addresses (URLs) to directly access and load third-party recipes within the App.

In this context, the App acts solely as a browser or technical tool to display this external content.

We are not the authors of the accessed recipes, do not adopt this content as our own, and have no control over the accuracy, legality, or quality of these external websites.

We assume no liability for any copyright infringements caused by the user accessing or saving external content.

4. General Limitation of Liability

We are liable exclusively within the framework of mandatory statutory provisions. This means: We are only liable for damages resulting from an intentional or grossly negligent breach of duty on our part, in accordance with the mandatory provisions of the German Product Liability Act (Produkthaftungsgesetz), and for damages resulting from injury to life, body, or health.

Any further liability (in particular for slight negligence, incorrect AI outputs, or indirect damages) is entirely excluded. We do not guarantee that the App or the connected backend services (including the AI API) will be available at all times uninterrupted and error-free. Furthermore, the limitation of liability set forth in the Apple Standard EULA applies, provided it does not conflict with these Terms of Service.

5. Apple-Specific Provisions

No Apple Support: You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

Third-Party Beneficiary: You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Service against you as a third-party beneficiary thereof.

6. Governing Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). However, since you are using the App as a consumer, this choice of law applies only to the extent that it does not deprive you of the protection afforded to you by mandatory consumer protection provisions of the country in which you have your habitual residence.

7. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
